SafeCat VPN - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SafeCat VPN ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Stackly Apps Private Limited ("we", "our", or "us").

If you do not agree to these Terms, do not download or use the App. You must be at least 13 years old (or 16 in the EU) to use SafeCat VPN.

2. Description of Service

SafeCat VPN is a virtual private network application for iOS that encrypts your internet connection and routes your traffic through our servers to help protect your online privacy.

The App is available in both a free tier and a paid subscription tier. Features and data limits may differ between tiers. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use certain features, you must create an account. You agree to:

• •Provide accurate and complete information during registration
• •Keep your login credentials secure and confidential
• •Notify us immediately of any unauthorized access to your account
• •Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Store-mediated Purchases:

All paid subscriptions are processed through Apple In-App Purchases. By subscribing, you agree to Apple's Terms and Conditions. We do not directly handle or store your payment information.

Auto-renewal:

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. Your Apple ID account will be charged upon confirmation of purchase and at the start of each renewal period.

Cancellation and Refunds:

You can manage or cancel your subscription at any time through your iOS Settings > Apple ID > Subscriptions. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial subscription periods, except where required by applicable law.

Free Tier:

The free tier is provided free of charge and may have data, speed, or server limitations. We reserve the right to modify the free tier limits at any time.

5. Acceptable Use

You agree to use SafeCat VPN only for lawful purposes. You must not use the App to:

• •Violate any applicable local, national, or international law or regulation
• •Transmit, distribute, or share illegal content of any kind
• •Engage in hacking, phishing, or any unauthorized access to systems or networks
• •Send spam, malware, or other harmful software
• •Conduct denial-of-service attacks or disrupt other users or services
• •Infringe the intellectual property rights of others
• •Circumvent geographic restrictions in violation of a third-party service's terms
• •Resell or redistribute access to the VPN service without our written permission

Violation of this section may result in immediate account suspension or termination without refund.

6. Apple App Store Terms

SafeCat VPN is distributed through the Apple App Store. Your use of the App is also subject to Apple's App Store Terms of Service. You acknowledge that:

• •These Terms are between you and Stackly Apps Private Limited, not Apple
• •Apple has no obligation to provide maintenance or support for the App
• •Apple is not responsible for any claims relating to the App
• •Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

The App may only be used on Apple-branded devices that you own or control, as permitted by the App Store usage rules.

7. Intellectual Property

All content, design, code, trademarks, and branding in SafeCat VPN are the property of Stackly Apps Private Limited and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or reverse-engineer any part of the App.

8. Disclaimer of Warranties

SafeCat VPN is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that:

• •The App will be uninterrupted, error-free, or secure at all times
• •Any defects will be corrected
• •The App will be compatible with all devices or iOS versions
• •The VPN will provide complete anonymity in all circumstances

Use of the App is at your own risk. We strongly recommend not relying solely on a VPN for security in high-risk situations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Stackly Apps Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or 10.00 EUR if you used the free tier.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access immediately and without notice if you violate these Terms or engage in conduct harmful to other users or the Service.

Upon termination, your right to use the App will cease immediately. Sections 7, 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by the laws of India, where Stackly Apps Private Limited is incorporated, without regard to conflict of law provisions.

If you are a resident of the European Union, you may also have rights under applicable EU consumer protection laws, which these Terms do not limit.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and notify you through the App or by email for significant changes. Continued use of SafeCat VPN after changes are posted constitutes your acceptance of the updated Terms.
